1. Who we are

Aussie Bot Labs Pty Ltd (ABN: 35 691 749 756, ACN: 691 749 756) ("we", "us"). Our website is aussiebotlabs.com.au (the "Site"). You can contact us at info@aussiebotlabs.com.au or via the Site's contact form/Calendly widget.

2. What these Terms cover

These Terms apply to your use of the Site, including our AI chat bot accessible from the Site (the "Bot"). If you purchase any products or services from us, additional or separate terms may apply.

3. Accepting these Terms

By using the Site, you agree to these Terms and to our Privacy Policy below. If you do not agree, please do not use the Site or the Bot.

4. Using the Site and the Bot

• Be lawful and respectful. Don't misuse the Site or the Bot, interfere with security or access, or try to scrape, reverse engineer or overload our systems.
• If the Bot allows you to upload content or data ("User Content"), you must have the rights to provide it and it must not be illegal, harmful, or infringe anyone's rights.
• The Bot provides automated outputs that may be inaccurate or incomplete. You must verify important information and do not rely on Bot outputs as professional advice. The Bot is not suitable for emergencies or time-critical matters.

5. Intellectual property

We (or our licensors) own all intellectual property in the Site, our content, software and branding. You may view and use the Site for your own internal business or personal use. You must not copy, modify, distribute, or create derivative works from our content unless we say you can.

6. Your content and a limited licence to us

You retain any rights you have in your User Content. To operate and improve the Site and the Bot, you grant us a worldwide, royalty-free licence to host, store, process, transmit and display your User Content and to create non-identifying aggregated or de-identified data from it. We will handle personal information in line with the Privacy Policy.

7. Third-party services

The Site integrates third-party services (for example, Google Analytics and Calendly) and our Bot may use third-party AI/LLM providers located outside Australia. Those services have their own terms and privacy practices, which you should read.

8. Pricing and product information

Any product information or pricing shown on the Site is indicative only and may change at any time. The actual price and terms for any purchase will be as set out in a quote or order form we accept.

9. Availability and changes

We aim to keep the Site and the Bot available, but we may add, remove or change features and we do not guarantee uninterrupted access. We may update these Terms from time to time by posting a new version on the Site.

10. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot be excluded.

Subject to those non-excludable rights and to the maximum extent permitted by law:

• the Site and Bot are provided "as is" and we exclude all warranties; and
• our total aggregate liability arising out of or in connection with the Site and the Bot (whether in contract, tort including negligence, statute or otherwise) is limited to AUD $100 or, if you have paid us fees in the 12 months before the claim, the amount of those fees, whichever is greater.

We are not liable for any loss of profits, revenue, goodwill or indirect or consequential loss.

11. Termination

We may suspend or terminate your access to the Site or the Bot at any time if you breach these Terms or if we stop providing the Site or the Bot. You may stop using the Site at any time.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of that State have non-exclusive jurisdiction.
